Legal Question in Criminal Law in New York

victim is arrested

I was assaulted on April 18 2008 in

the Belmont Steak House in Queens

by a mob of drunken patrons, one of

whom was my ex b.f., who triggered

the assault, and one of whom broke

my nose (see hospital records). I

called the police who did not take me

seriously. (Rumor has it that the

Belmont is a notorious 'cop and mob

hangout' - unbeknownst to me.) Two

days later, the ex b.f. filed a false

assault claim against me that led to

my arrest. The other assailants have

not been arrested - despite my

continuous requests to Ray Kelly, et

al. I FOIL'd the information against

me, and was horrified to see the lies

that the police acted on. I have been

kept in the dark, even though I was

the victim from the start. The police

are now threatening me with arrest,

for asking them to help me with the

assailants, whose names and

addresses I have been able to find

out with the help of other police

force. What should I do??? How do I

get the help that I am entitled to??

Why was I arrested, and the mob

that assaulted me as if it were a

spectator sport is still singing karaoke

in the Belmont??

Your post raises a lot of issues and I can't understand exactly where things stand with your case or what you are asking. When were you arrested and what are the charges? Did you make your FOIL request before the arrest? Are you saying this was a retaliatory arrest? If in fact you have been arrested and charged, obviously you need an attorney to help you make sense of everything.
