Violation in NYS

Briefly- I was arrested in 1997 at age 19 y/o for a class A misdemeanor in NYS for shoplifting. I went through the court processes to reduce it to a violation PL 240.20. Now 11 years later I am a physician and have not had any other similar situations since then. Two questions, do I have to disclose this as being convicted of a ''crime'' if they don't specifically say a convicted of a misdemeanor or felony on a job app? And is there any way to expunge it or ensure that it is sealed?

PL240.20 is a violation and not a crime. Additionally it happened while you were a youth and hopefully was sealed.You can truthfully answer you were never convicted of a crime.Finally records in NYS do not get expunged. Feel free to contact my office for any legal questions.

No need for any of thise things, and hopefully this message will leave you in better spirits...

in NY 240.20 (disorderly conduct) is treated as a violation and not a crime... the difference being that a violation is on par with a speeding ticket...

you have no criminal conviction on your record, if this is the way your case was disosed of... on ALL applications you can state that you have no convictions and you would be absolutely truthful...

there is nothing to expunge...
