Legal Question in Criminal Law in New York
Waiting autopsy reports
My friend was arrested after finding his girlfriend dead on the bathroom floor of their home. He is still sitting in county jail awaiting autopsy results. How long can they hold him without evidence that he committed any crime..

Re: Waiting autopsy reports
Within 24 hours of his arrest, your friend had to have been brought before a judge to be arraigned. At that point, there must have been SOME evidence, in the nature of an affidavit or other evidence, for them to continue holding him in custody.
