Legal Question in Criminal Law in New York

A few weeks ago, I was with a friend of mine in HIS car with my boyfriend as well and the "friend" got pulled over. My boyfriend had heroin in his possession and my friend had $200 worth in his center consul which the officers refrained from searching his vehicle or his person. I was not in possession of any substances or paraphernalia what so ever however, today in my first court date, I received a packet stating that I had a yellow wax bag with a tan substance inside it. I geniunly did not have ANYTHING on my person and, there was nothing even on the back seat where I was sitting/the floor. All of the drugs in the vehicle were either in my boyfriends person, the informants person, or his center consul. What can I do? I will have a public attorney as I can't afford one but, I do not have any proof that I can't afford one(which is required for my next date in two days). How would I obtain some kind of proof?

Go to the court clerk and ask for an affidavit for assignment of an attorney. They will give you a financial aid form. You have to fill it out and swear it is true. I'm not sure what documents you think you need, but you must be honest about your assets. In Yonkers, the general rule is that if you don't own a home, don't own a car and earn less than $400 per week, you are entitled to an attorney. there are other factors like supporting a child.
