Legal Question in Criminal Law in New York
my wife and i are very stressed out over this problem we have. our grandson who is 24, is addicted to heroen. unfortunetly i insisted he go into drug court. thats when all the problems started. he commited only one crime 4 years ago(they robbed matts mothers safe for over 1,000 dollars) with his codefendent. timmy and matt have beenn treated totally different with there cases. matt has done his time and got back his life.
timmy on the otherhand has beeb moved from rehab to rehab all over n.y. state. it has been 4 years and timmy still has only that one felony all this time matt has gatherd up more felonies by forging checks. to get heroen. so now timmy is in the county jail again, missing appointments or just not goings along with the rehab people. he has a hard time kepping his mouth shut. anyway now the want to put him state prison for that same felony he commited 4 years ago. they just keep shuffulling him around he did get off the dope for about 2 years. he has fallen since then. timmy wants to do county time to finish up his time and get this all behind him. state prison will just make our grandson hard and we love him the way he is. can any one tell us tim has a chance. you tricked me, it said free answerd questions. shame on you.

Actually the service basic service is free, the enhanced service allowing you to pay a nominal fee to an attorney for more in depth answers and followup is available as well.
As for your grandson, a felony is punishable by at least one and one third year in state prison. If he violated the contract he entered into in drug court, he is subject to the punishment that was listed in the drug court contract as an alternative sentence. If he has a private attorney, I would call them and see what could be done, if he does not have a private attorney, get one.
If he has continued to violate the contract multiple times, he might be out of luck and will go to state prison.
