Legal Question in Criminal Law in New York
My wife of 10 years recently had me arrested for Harrasment 2nd pl 240.26. During an arguement when she refused to give me my cellphone, I reached into the back of her pants to retrieve it. Do I have the right to take back my phone?

Get a lawyer-this can blow up in your face. Sounds like "self-help", something the courts frown upon and courts are also increasingly worried about domestic violence, esp since it is becoming worse as the stress on people because of the economy gets worse. I am not stating what you did is DV but it can be seen as such-a crimnal law atty experienced in your area, who knows how the judges and DAs think, is invaluable here.
