Legal Question in Criminal Law in New York

Wondering

Husband was convitted last year for grand theft not auto and he was sentenced as a 2nd felony offender but he was not he wrote the higher courts and they acknowledge their was a mistake but no one is doing nothing about it , however what can he do about it he has put in appeals and writs still no answer. he is doing a 1 1/2 to 3 yr. bid he has in 1yr how much more does he have to do?
