Legal Question in Criminal Law in New York
wrongful conviction of rape
Conviction of rape of a 13-year old based solely on an allegation. Can this conviction be overturned even though the person convicted served , in full, 9-18. Are there attorneys that would be willing to right the injustice and undertake a lawsuit for the wrongfull convicted person?

Re: wrongful conviction of rape
If the person has pursued all his appeals there isn't much that can be done. What about DNA?

Re: wrongful conviction of rape
Before you could be successful in a civil law suit for damages, you would have to have the conviction overturned. If the person has already served his time and exhausted all of his legal options, that may be difficult unless there is some newly discovered evidence.
