Legal Question in Criminal Law in New York

Wrongfully imprisoned

I am writing on behalf of my boyfriend who is in jail. His wife has charged him with Rape with use of a weapon and several other charges. He has stated he is innocent. She waited 5 days to report the ''crime'' and also has stated she had sex with another man the day after the ''rape''. The public defender hasn't taken any statements from anyone on his behalf. I wondering if there is any free legal aide in our area. We have witnesses on his behalf were she has stated she did this because she was mad because he left her. We have dates and times. There was a request for evidence from the DA office and they haven't turned evidence over yet. She has been charged before with falsifying records and lying to law officials in the past to get herself out of retail left.

Re: Wrongfully imprisoned

You really have to deal with the Public Defender if you cannot afford an attorney. Their Offices have investigators and while they are not funded as well as the prosecution, they will likely have more experience than any attorney who would be willing to take the case for what you can afford. You may want to consider hiring an attorney for the limited purpose of a bail reduction hearing but in some Counties the attorney may have to enter his or her appearance to do that and then be in the position of having to take the case.
