Legal Question in Criminal Law in New York

New York City Possession of Marijuana in Park

I have a summons for the charge ''Possession of Marijuana in Park.'' This refers to Central Park in Manhattan. The officer who gave it to me said that it constituted only a violation and not a misdemeanor, but I want to be sure before going to court. It says ''In violation of Sec. 104 Sub. H'' and this isn't under 'Penal Law' but is under 'Other', because apparently law enforcement in the Park is different from that in the rest of the city. Could you tell me whether this is considered a violation or a misdemeanor, and, in either case, what the ensuing punishment might entail?

My recollection is that violations in a NYC park are misdemeanors. However, if you have no prior arrests you will get a favorable outcome.

It would also give you the best chance at a significant reduction or dismissal of the charges. We have substantial experience handling these types of cases, however, we would need some more information before making a complete and proper determination. This is a Misdemeanor, overall if there is no previous record the COurts tend to offer what is called a Marijuan ACD (Which results in a dismissal) or a 240.20 disorderly conduct (which is a violation, not a crime...
