Legal Question in Criminal Law in New York

New York State Interstate Compact Laws

My husband was granted a interstate compact from New York state to Florida. He violated the conditions of his parole in Florida and is now currently being held in Florida, waiting for New York to make a decision as to weather or not they are going to pick him up or leave him. My question is this, how long, by law can they hold him, ie, how long do they have to make a decision? It has been a month all ready and we can't get any answers from anyone in regards to this. Some people are telling us they have 30 days and others are saying they can hold him as long as they want. I'm desperate as I have a toddler at home and I need him here! Any help is greatly appreciated!

Re: New York State Interstate Compact Laws

If he had not been convicted of a crime and out on parole then the state would be limited on the amount of time that they can hold him. Since he is on parole, they have almost as much time as they want up to the amount of time he would have served if he had not been released on parole. You would be well advised to get him an attorney in Florida to consult with. They might be able to have him released on bail or at least file a writ on his behalf. It might or might not work.
