Legal Question in Discrimination Law in New York

Discrimination based on place of birth

I was supposed to visit a U.S. military site(located outside U.S.)as a member of an engineering team. My personal info, like SSN, place of birth(a city in middle east), status(U.S.Citizen)etc. was sent to the client(a subdiv. to Navy), and I was given clearance to go. But later I was told I can't go because i was not born in U.S. Is there a legal basis for this denial? Under any circumstances?

Re: Discrimination based on place of birth

As a former military man who spent a fair amount of time dealing with security clearance issues, my guess is that you ran afoul of a security clearance problem.

There are some security clearances that cannot be granted to foreign-born individuals without extensive background investigations. I suspect that you were not cleared for access to the site.

The military is given wide latitude in setting standards for security clearances, and thus what they did is most probably well within the law.
