Legal Question in Discrimination Law in New York

Me and my girlfriend were at a bar and they called last call she finished her drink and proceeded to the bathroom. About 2 minutes later the owner opens the womens bathroom door (he's male) and tells her (while partially unclothed) to get her fat ass off the toilet!!! Is there anything that can be done???
