Legally, he can ask...he cannot engage. However from a policy standpoint, it is in poor judgment on the guidance counselor's part, at least so if he took this direct inquistive or accusatory approach as you suggest, and if I were a parent I would be interested in an explanation as to his motivations. It might pay to schedule a meeting with this person and if suspicions warrant, possibly school administrators.
