Legal Question in Discrimination Law in New York

Hostile Work Environment

I work at a large hospital and weeks ago, I complained to my boss about anti-gay comments from a female co-worker. The next week, this woman and another had an conversation in front of me, saying that she got into trouble for saying the word ''lesbian'' and they narrowed it down to myself or a woman in another dept as the source. The next day, I met with both of my bosses and described this and they said they would speak with them and that they'd get a verbal warning. That very afternoon, one woman continued making remarks in front of the boss, such as ''Oh, I can't say this, or that now,'' and my boss merely told her it was inappropriate. Since then, it has been ongoing with comments like using the word ''gay'' and then following it up with ''Oops, did I say that?'' Or ''Don't talk loud, since we don't want to offend anyone.'' Then, one had her sister come in and say the word ''dyke,'' while my other co-worker said ''butch'' and said she was entitled to say that word. I am really getting annoyed with the subtle comments and it is making it hard for me to do my job. Do I have a case?

Re: Hostile Work Environment

Potentially, but I would need to know more details including where your office is located and whether its in a jurisdiction which protects against discrimination based upon sexual orientation. There is no national protection currently.

Should you like to discuss this or any other legal matter, you can call my office to schedule an appointment for a consultation or in the alternative, I can be reached for on-phone low-cost legal consultation at 1-800-275-5336 x0233699.
