legally able to have sex?

im a 19 year old male who is currently dating a 16 year old, are legal to have sex in NYC ? or does our age difference not allow us?

the age of legal consent in NY State is 17 - while most instances the DA's office will not prosecute as heavily matters where there is a small age difference, it is still reasonably possible and technically illegal till the age of 17 for your girlfriend to consent to sex, so if there is a rape charge brought against yu - you would not have any real defense... your best bet is to wait till she turns 17 and can then legally consent
