Legal Question in Discrimination Law in New York
Wrongful incrimination
My fiance was wrongfully put in jail over a crime that he did not do. He is home now after servicing most of the three years that was given to him and while he came home he met up with the young man that the police claimed made the accusations against him. We spoke to the gentleman and he told us that when the police came over to his home and told him that my fiance was the one that broke into his car and for him to sign a statement; he refused. This gentleman's name was all over my fiances paper work claiming that he was the one that filed these charges against him, charges that he did NOT do. I would appreciate someone getting back to me. What kind of a system is this that can put an innocent man in jail for three years? Please some one respond. Thank you and may God bless,

Re: Wrongful incrimination
This might be a difficult case. The question is the credibility of the witness who now denies statements attributed to him.
It might be best to file an action in order to get the police file. That would go a long way to showing who is telling the truth - the witness or the investigating officer.
This must be done within 60 days of his release from jail.

Re: Wrongful incrimination
One that is imperfect. That being said your fiancee may be entitled to compensation if there was some fault involved. IF he would like I would be willing to discuss his wrongful imprisonment with him.
