Legal Question in DUI Law in New York

15 years ago in my early 20"s i received a dwai "violation' in n.y.. since then i wised up and moved on. a coiuple of months back i got my nys mvr and it was clean- showed no dwai violation. i got my mvr because i went to a truck driving school to get my commercial drivers license. which i have since gotten. looking for employment many application asks about dwi convictions. i have been honest and have put it down, but i think it may be holding me back. so my question is- since a violation is not a criminal record and my motor vehicle record is clean can i just forgo such info? is there a way for a potential employer to find this info? thanks

The short answer is if the question asks about a criminal conviction then you can answer no because an impaired is a violation and not a criminal conviction, If the question asks about an arrrest or about any traffic tickets or alcohol related offense then you would have to disclose the impaired conviction. Hope this helps. Good luck.
