Legal Question in DUI Law in New York

My bf had a PSI today in Suffolk County NY. Were hoping for the 5 years probation as told by the judge but what if at his sentencing the POs sentencing suggestion states she thinks he should spend some time behind bars? What are the chances of the judge sticking with the 5 years probation? Is there anything he can do to make himself a better "candidate" for papers before court and is there anything specific other than the obvious he shouldn't do or avoid so he can avoid time upstate?

It is extraordinarily rare for a judge to go back on their promise, and if he/she does, your boyfriend will have the opportunity to withdraw his plea rather than be sentenced to jail. As I said however, it's extremely rare for a judge to not give the promised sentence.
