I was charged with dwi in nys. Appeared in court and pleaded down to dwai on 8/19/10. Was fined $300 plus $260 surcharge and 1 yr condit. discharge. Judge said he would waive 300 fine and put that on cond disch paperwork. 9/23/10 letter from court received stating that fine can not be waived since sentenced to 1 yr condit disch. Can they change the sentence after court proceedings completed and plea and conviction accepted?
