Legal Question in DUI Law in New York

Drunk Driver received injuries
My husband was at a bar and left intoxicated and caused a car accident. No one was injured except for my husband who suffered near fatal injuries and required open heart surgery. Is he entitled to sue the bar he was at? Does the dram shop act apply to him or just third party?
