Legal Question in DUI Law in New York

Drunk Driver received injuries

My husband was at a bar and left intoxicated and caused a car accident. No one was injured except for my husband who suffered near fatal injuries and required open heart surgery. Is he entitled to sue the bar he was at? Does the dram shop act apply to him or just third party?

I do not do this kind of work and can not answer the question without looking it up.

However, I strongly suggest you sit down with an attorney and see what your options are. You might have a claim against the Bar who over-served him, I dont know. But I know some very sharp attorneys who could help you (I checked your zip code and you are near me). Please contact me, and I will see what I can do to hook you up with a good lawyer.
