Legal Question in DUI Law in New York

dwi arrest on my property

I have a neighbor that was harassing my family since I moved into my

house,she uses profane language at my kids when they are playing in

yard.....I was drinking and doing work around my yard....I got into my truck

and drove in my yard to my shed when I got stuck...I went in my house to use

my phone when in a few minutes cops opened my door and ask me outside...they

asked me if I was drinking I said yes but I wasn't driving on road...they

called the da the da said if I was not on road they couldn't do

anything...well the neighbor was eavesdropping and heard that she said

officer I seen him drive on road she signed a deposition and cops arrested

me for dwi.....this lady has been out to get my family since I moved

here...she assaulted the previous owner......any advise to get this dropped

If you want complete exoneration this case requires a full investigation and trial, which may prove time consuming and costly. There does seem to be a great deal of possibilities for plea-bargaining inasmuch as no breathalizer or other alcohol detection tests were performed nor did the police arrest you at the time of alleged occurance. There is no simple way to get this dropped. You will need a lawyer to defend you. The case may have to go to trial.
