need to know if he needs a lawyer for a first time offense he already enrolled in a ny ceritied alcohol treatment program

Since a DWI in New York can carry up to a year in jail having a lawyer would be a very good idea.

Yes, he should have a lawyer. Every County deals with DWI a little differntly but all the Counties have been getting tougher on them. Its good he got into a program and that could help deal with the case. However, how the case turns out depends on the facts, i.e. did he take a breath test, what was the result, was there an accident, property damage or personal injury? All of these facts get taken into account by the DA. A good criminal lawyer will help negotiate the best possible outcome and lowest possible sentence. While jail is possible (if really bad injuries), its unlikely on a first offense but there are fines and possible community service to deal with, which you want to keep as low as possible. I am a former federal and State prosecutor and now do criminal defense. I have handled many DWI cases so please feel free to contact me.
