Legal Question in DUI Law in New York

DWI - will they take my license at the arraignment?

I have to make my first court appearance on a 11923 DWI and 11922. I plan to plea not guilty and hire a lawyer. I am hoping to plea it down to a violation, as I have never been in trouble before. Will they take my license at the arraignment or will they wait until I have been found guilty? I am over 21. I need my license as I live really far from my job. I know I need counseling and am going to try to get into treatment before my first court date. Will that help me keep my license?

You will likely have to turn in your license, however you may qualify for a conditional license which will allow you to drive for your livelihood. Please contact my office @7188340087 for more info.

Various counties handle this diffrently... So it depends on the county... Feel free to email me for further info...

Generally, however, there are a variety of ways to keep your driving privileges such as a conditional license, a stay of suspension, a hardship license etc.
