Legal Question in DUI Law in New York

I need some help please...

On november 11th i was pulled over for supposedly running a stop sign and later took the breathalyzer test and blew a .07. The police took my license that night and didnt return it. I went to a dmv hearing on the 18th and the judge said the case could be dismissed but i had already sent out a waiver form cause the cop told me to. So im being charged with zero tolerance. I was wondering if anyone knew if the case could be dismissed and if they could turn around and charge me with DWAI? or if i can be charged with DWAI under 21?
