Legal Question in DUI Law in New York

Possibility for getting only the following punishments DWI?

Arrested DWI. When arrested not pulled over Pulled over rear private parking lot. Blew 0.1. First time. At that time I have learners permit only (I am the only person opeated car).No acident/no injury/no harm.

Got tickets 2 for DWI.

(1-DWI misd).

(2-DRV'G w/0.08 of 1% or more ALC MISD)

Got other 3 tickets.

(1-failed to show insurance card

2- no headlights

3- unlicenced operator - permit only ). Court date is 09/07/2007.

Could you please suggest if it is possible to accept following punishments only in the first appreance itself ( As I am leaving from US on September end, I dont want to appear court again).

I am going to hire a lawer as my master

1. from DWI to DWAI

2. licence suspensition 45 days.

3. Ready to pay fine 2000$ or more

4. Want to avoid jail, AA classes, probation & community services.

Please!! please!! help possiblity for the above charges only. I would most appreciate to expalin in detail in this. Based on this I can get a attroney and expalin him.

You will not see jail. The fine will be far less than $2000. The issue will be the license suspension, and the impaired.

If the conviction is for the impaired (DWAI)the suspension is for 90 days and is only relieved by completion of the drinking drivers program.

If the conviction is for the misdemeanor DWI then the REVOCATION is for a minimum of 6 months and maybe longer.

Chances are with a first offense and a BAC under .11 you will get an offer of a DWAI but you should get a lawyer immediately and he needs to try to get to the ADA on your case before he goes to court or you may have to return to get all the benefits that may be coming to you.
