Legal Question in DUI Law in New York

Postponement of court hearing

I got a DWI 12/00. I first retained an attorney who postponed the court date so I could get the evaluation and the out patient classes scheduled. I went back to court with a few weeks completed and my attorney postponed the court date until the classes were completed. My attorney postponed the following court date after completion of the classes because he was awaiting hearing from the DA. I was upset at the postponement of the court date and retained a different attorney. Now this attorney had postponed the court date to July 25th. I spoke with my new attorney today and he mentioned it being postponed again. WHY do they do this; what is he trying to achieve? I was ready to pay the fines five months ago

i fully retained my new attorney and am ready to pay the fines due at this time. I don't understand!

Thanks!

Re: Postponement of court hearing

There is a multitude of reasons for delay

Your attorney told you some, namely, to

permit you to show the court that you

have done something which should prevent

you from ever appearing again before the Court

Delays in criminal defense are essential to

the defense. He may have the wrong judge and

is hoping for a time when he is off. The

same is true of prosecutors. The Judge

may not yet be convinced, but will be

with the passage of time.

Delays work to the benefit of the defense

in most instances. This includes things

being lost, and police officers being

unavailable.

Don't be in such a rush to get it over.
