Legal Question in DUI Law in New York

why does new York state dept of motor vehicles have the right to revoke my license for 5 years even if the judge is willing to give it back to me after a 90-day suspension. I fall into the category of them going back 25 years for drinking related incidents. I refused to take a breathalyzer on this offense, but the dmv is treating the no-blow as a conviction.

Yes, the DMV can suspend/ revoke even if the judge does not, or the judge issues a different suspension.
