Legal Question in Education Law in New York

college processing fees/refunds

I applied to a college I paid the $250.00 processing fee, decided I was not going to attend there but a college close to home. Two months later they issued a refund for that amount.Three months after that they called and said it was a mistake that they should of never sent that check and it was an error on there part. Now they are billing me in that amount and late fees in addition to that amount. Is that legal??Do I have to pay them back

Re: college processing fees/refunds

If in fact you notified them that you had changed your mind and would not be attending their school and they then refunded your money, you probably would have a good defense to a possible lawsuit they might bring against you for the $250.

On the other hand, how likely is it that they will sue you for $250?

They might refer it to a collection agency, but there are ways to have a collection agency stop harassing you.

They can't threaten to spoil your credit rating because you really don't owe them anything and if they do, you can sue them.

I wouldn't lose any sleep over this.

Send the bill back with a notation that you dispute their claim.
