Legal Question in Education Law in New York

Refused Education

My daughter is 14 and was suppose to start the high school.

She has not gone yet because she refuses. She was assualted last school year and is scared to go. She is scared of the bullying that goes on also. The state police has a statement also. I want to enroll her into the alternative school and the regular school refuses to let her. Isn't that illegal? She has the right to an education. I'm not sure how to go about handling this now.

Re: Refused Education

Your daughter is entitled to a free, appropriate Public School education. If she has a handicapping condition, she is entitled to necessary modifications of her program. Each school district has a committee on special education which accepts referrals and must evaluate students to determine their needs. If your daughter is phobic, due to being harassed, she may qualify.
