Legal Question in Education Law in New York

school threat

my son was threatened by another student (age 15) when the student brought a knife to gym class and threatened our son with it. we are concerned that this student will be allowed back to school in the fall. Our school has a zero tolerance policy.we were told that we have no right to know the outcome of the hearing and whether or not this kid is coming back to school. our son is concerned that this kid may do this again.Rumors are that this kid is coming back after only a 1 month suspension. in our code of conduct it states a minimum of 1 year school suspension. What rights do i have to make my son feel safe at school or does he (the victim) have no rights?

Re: school threat

You and your child have rights but they may not be through the school district. You may need to make a complaint at the 7th pct. and have them seek a court stay away order. You may also have a civil suit. Contact a lawyer right away as time limits are passing.
