Legal Question in Education Law in New York

Special Education Placement

I have been told the state has approved me to be sent away for residential treatment. I was placed out of school for my ''severe diablility interacting with peers.'' In 8th grade they sent me to family court because I told a teacher that I created a computer game where kids heads popped up and you shoot them. It was all stick figures, no details; no names. The judge dismissed the case but advised the school to find a placement for me. In two weeks after eight months of there hard trying they found me a place. They openly stated that the school was not the right place for me it was just to tell the state that they tried all options so they could place me. I dont want to be placed. What can I do. Thank you very much. I have an interview on Thursday for a school.

Re: Special Education Placement

Basically, you need medical or psychological testimony that the proposed placement is inappropriate for your educational needs and is not the "least restrictive environment" for assuring your educational progress. You need an attorney to make these arguments. You should try your local legal sevices office or bar association for a referral.
