When my dad was alive, he gave me POA and told me to go to the bank and take out money. I did and gave it to him. When he died, he made me executor and now my brother is accusing me of stealing because he subpoenaed the bank records and said that I took the money out and it should've been in the estate. Some of the money was used to pay bills that my brother made (he lived with dad and ran up all the bills), plus he caused a claim against the estate by using signing dad's name to some credit, now he's calling me a thief! I don't have any proof that I didn't take the money, but my dad was alive and I only did what he wanted. What is my recourse here? We have a trial coming up soon. Will the judge make me pay back money that I never kept?

What do you mean 'you have a trial coming up'? If you are the executor of the estate than I assume you hired an attorney to file the probate petition. Sounds like you have a lot of issues here and I'm not sure I understand them all.
