Legal Question in Entertainment Law in New York

reality tv show threatening to sue me

HI, a month back i auditioned for a

reality tv show and passed the fist

audition. The second round of

auditions were to be held in europe.

At the time i felt i wanted to see how

i would do so the tv show paid my

expenses (as with all contestants in

america) to travel and take part in

the next audition. I signed a release

form so that they could use my

image on tv whether or not i made it

onto the live portion of the show.

While in europe i was told that if i

made it through this next stage i

would have to sign a contract saying

that i could not quit the show. After

returning to the U.S i recieved a call

telling me i had passed. No contract

was sent or discussed. The next day i

realised i would have to quit my job

to go back to europe and do the show

so i told the organisers that i no

longer wanted to continue. I NEVER

signed any contract. Now they are

threatening to sue me for damages if

I do not do the show, as they used

me in their promos and say that i

would be damaging their company's

image and ratings if i dont take part.

Can they really sue me, and if they

do, could they win??

thank you for taking the time to read

this..

Re: reality tv show threatening to sue me

It would depend upon what the release said but it's highly unlikely they could use the release because they mentioned the actual show would require another contract. Having withdrawn before signing the show contract, I'd say you owe them nothing, but a final answer would depend on agreements you did sign and what they require of you. It's likely however that they can use your footage shot pursuant to the release(s) you did sign.

Re: reality tv show threatening to sue me

It would depend on what the agreement you signed says. You should have a lawyer review it and advise you of any liabilities and defenses you may have.
