When the writer negotiates the credit, subject to being a WGA member in which case WGA rules apply. That's the easy answer. The more complicated answer depends on whether the screenplay is a work-for-hire, speculative or assigned and how much the writer contributed but that has more to do with the legal position the writer could take if the writer wrote the script, the film was going to be produuced and the credits were wrong and/or misleading.
