Legal Question in Family Law in New York

I'll be 17 in June.I live in FL.with my stepfather who got temporary custody of me two years ago in New York, because my mom had a subtance abuse problem.I stay with my mom in NY on hoildays and summer vacations.This summer when I go visit her I went to stay with her.She is free of drugs, working,and has her own place for a year now.She wants me back,but is unable to serve him with the petition,because he's in FL.He won't give her the address.And I'm afraid to give it to her because I'm very afraid of him.Can I stay with my mom??without any trouble??

NO you cannot without a court order changing custody to your mother.
