Legal Question in Family Law in New York

2 kids wanting to live with us.

my uncle died 3 yrs. ago . and his girlfriend died on oct.8,2007now the children want to live with us. there mother's sister has children of her ownand tells us that we could have them both. But we want to know if she could write us affidavit stated that she'll give us the kids. The only is that all she has is the dealth certificate on both parents. And the kids receive social sercurity from their father. Could you be so kind and tell us what we could. We are living in florida and this is where we want them to have a good life.

If the kids are here in New York, then you should file for guardianship here in New York. This way you will have a court order giving you the authority as if you were their parent. It should be filed here if this is where they live currently. Contact me and I can get it started for you.
