Legal Question in Family Law in New York

2 ?? about Legal Separtion...

Part 1) I think my wife is going to serve me with papers asking for a Legal Separation. What are the steps / process for doing this so that I know what to expect. Part 2) I am trying to find out if my wifes boyfriend is still married... I can not find any civil records within Monroe county showing separation or divorce... so my question is: does one HAVE to file Separation paperwork in the county that is your primary residence...or do you file it in the county that you were married in... or can you pick any couty that you want? If you were trying to keep it quiet from your neighbors.

Re: 2 ?? about Legal Separtion...

The papers can be filed in the county where you reside.

How long have you been separated?

Are you interested in a divorce or do you want to reconcile with your spouse?

Sincerely,

Patricia Martin-gibbons, Esq.
