Legal Question in Family Law in New York

In 1982 I married an Italian citizen in Italy. My wife and I resided in the USA for 6 years before moving to Italy in '88. We are now legally separated by an Italian court. Are the marriage and separation recognized by the U.S.? Can I now file for divorce in the U.S. even though I reside in Italy? If so, what needs to be done and how much would it cost, approximately. Thanks much.

1. Your marriage is recognized in the US.

2. You can file for divorce in NY as long as your spouse has lived in NY for at least the last two years, or at least one year plus another legally recognized circumstance.

3. Our law firm can handle your divorce for as little as $695 complete. Many other firms charge $1500 or more.

I disagree with Steve on point 2. If you and your wife have been living in Italy since 1988, New York does not have jurisdiction for the divorce (even if you lived in NY from 1982 to 1988). You would have to file for divorce in Italy.

Mike.
