Legal Question in Family Law in New York
6th Amendment Rights
In a child abuse case that goes to court, most states uphold statuts stating that the child does not have to be present in the court room. If the attourney for the adult were to argue that the child not being present is a violation of their clients sixth amendment rights, what evidence could they use to back their arguement?

Re: 6th Amendment Rights
This poses a very interesting problem. My offthe cuff opinion is that this fact pattern supersedes the 6th amend due to the sensitive testimony of the child. to research this problem fully either use a law library or hire a competent civil rights attorney.
