Legal Question in Family Law in New York
My 18 year old daughter wants to leave home but has not completed high school ye
I need to know the laws regarding my daughter. She will be 18 years old in July of this year and is planning on moving out on her own. She is in the 10th grade in high school. Do I have to let her move out, or do I have the right to keep her home until she graduates? She is very immature (only about 14 years old as far as maturity goes). If she can leave home, what about the child support that I receive, will it stop? Will I still be liable for her medical needs if she moves out? I am a single mother of 4 teens and I have not been able to work for almost five years due to a back injury on the job, so I currently attend college to try and learn some new job skills, VESID pays for it.

Your daughter may leave your residence if she so chooses at her age, unless there is some sort of disability or her maturity is so poor that a court will consider her in need of a guardian. She is an adult for most purposes (and actually was before 18). As for the child support question - that depends on how your judgment of divorce reads. Many will state that child support may end when the child is emancipated or living on their own. You should have that checked with an attorney.
