my 16 year old daughter wants to live with me, can i lose?

I've been separated from my husband for 9 years and my daughter has chosen to live with me. We went through the court system when she was 14 in order for me to gain custody of her. My ex-husband won. My daughter is now 16 and we've petitioned again for custody. I've done alot of research and because she is 16, it's her decision, correct? I'm very confident, but still curious about whether or not we can win. please help!

The child does not have the right to dictate where and with whom she is going to reside, but her wishes will be taken into account.
