Legal Question in Family Law in New York
My 11 year old niece has lived with me for the past 2 years. Her parents are divorced. Neither one of them can care for her financially as neither works. Her father has custodial custody of the her and it was in the divorce papers that he has the say where she goes to school. I live in a different school district than her father and mother. Her mother is now taking her father to court to have my niece live with her. My niece has a law guardian who she is going to see this week. My niece's mother has been badmouthing the rest of the family and telling her that she is going to live with her soon. I want my niece to continue living with me for her own well-being. A long story...what recourse do I have to insure that she stays safe and with me?

You should see an attorney and consider bringing an action for custody to you and your spouse and or supporting your brother. This will be complicated and can be costly. I will say you are doing the right thing based upon your e-mail.
