Legal Question in Family Law in New York

I have a 2 year old and I am pregnant (due in march) , live in PA and am in the process of moving back home to NY. The baby's father will still reside in PA. The baby will be born in NY. The father of this baby is not my son's biological father and we are not married. When I move back to NY I will be moving in with my mother until I can find a job, get my feet on the ground and start going back to college. If my ex decides to go after me for custody, what are the chances that he will win? What rights do I have? What rights does he have?

The burden will be on the non-custodial parent to prove that you are unfit to be a parent.
