Legal Question in Family Law in New York

Hello, I am 38 year old professional who is potentially thinking of getting a divorce. My wife is aware of the possibility of a divorce. I do not know where to really begin. Feel a little overwhelmed. I have been married for 9 years. We have two children one 2 1/2 and the other 5 months old. We have a home and two vehicles. My annual income in 2009 was 54000, her income was 80000. We both are aware that this may be the best choice. But unfortunately we are living pay check to paycheck and really have no funding. Can you please advice how to begin. Are there any lawyers that might possibly be able to help. IAny links you can direct us as to each others right and responsibilities and how one may potentially go about beginning and following through ona divorce. Thank you in advance. I am hoping there may be someone who can potentially guide me in the right direction.

1. Gather all financial information. This includes tax returns, all asset (bank account, checking account statements), all debts (mortgage, credit card, etc.), and all income and expense documents.

2. Talk to your spouse and attempt to work out a plan with the children - who gets custody, who gets visitation, how will things (child care, medical, etc. be paid).

3. With financial information and a plan concerning the children, you may be able to seek an attorney for an uncontested divorce. You can contact your local bar association for a referral.
