Legal Question in Family Law in New York

My 17 year old ran away to live with his father, where there are no rules. He does not want to come back home. His father now wants custody and child support, because he owes me child support for all three of our children. He has always remained unemployed. Should I fight for custody and can he be awarded child support.

There are two separate questions.

First, although a child has the right to voice his decision regarding where he wants to live after a certain age, if you believe the environment is inappropriate, you may be able win.

Second, regardless of the outcome of the custody of your 17 year old, you should file a motion/petition for contempt to obtain back child support.
