Legal Question in Family Law in New York

I have a 7 year old son from a past relationship, his mother has 100% custody, I have visitation every other weekend and we split holidays and vacations. I am getting ready to move in with my new girlfriend which I have been with for a year and a half and she has a 11 year old daughter from a previous relationship as well, the place we are moving to is a 2 bedroom, so my son and her daughter will be sharing a room when my son is with me. My son and his mother are residence of the state of Vermont and I am a resident of the state of New York, the new place is located in New York as well.

My sons mother is giving me grief because they have to share a room, saying because of the difference of age and gender the state won't allow this. My question is, if she takes me to court over this matter, is she right?

Sometimes the courts will look at it this way since the young girl is close to teenage. You might want to discuss different arrangements for your son, maybe on a couch or some other area if this is not for more than a weekend. You might also consult an attorney as there would be a question as to which state laws were applicable, Vermont or New York. This can't really be solved online, speak with someone.
