my 4 year old sons name changed

I have sole custody of my, the father signed away all rights to him in 04, I would now like to change the last name. I would like to leave the last name the same as mine.Is this possible without any complaints from his father. I have not seen his father since the court hearing and his has not seen his father since he was 1 1/2 years old. My son starts Kindergarden in Sept. and I would like him to be called by my last name, it is the only one he knows.

you should contact a local family law attorney. you should be able to change the name if the childs father truly released his rights but you may have to get written release to change the name.
