Legal Question in Family Law in New York
My 17 year old step daughter was living with us. She had frequent violent outbursts. A few weeks ago she was having a outburst. She repeatedly slammed the door into the wall. The door broke off it's hinges falling to the floor while my 6 year old was a few feet away. I got my phone to call the police and she attacked me. She left bruises up and down my arms. I took my 3 small children and left. I told my husband I could not live with her anymore. A few days later she went to live with her mother. (we live in NY state and her mother lives in North Carolina) A couple of days ago she attacked her mother. She was arrested and is currently in jail. Her mother says when she gets out she can not live with her. She can not live with us either. I do not want my kids subjected to that behavior. Her mother is telling my husband that they will both be arrested if one of them does not take her back. What can we do?

No . . . you will not go to jail for refusing to house a violent person in your home. In fact, you and your husband should contact the N.C. prosecutor and the child protective services for assistance.
