Legal Question in Family Law in New York

Can my 19yo daughter be emancipated?

She has been living in her own apartment for the last 4 months and currently works full time. She was in college full time for the Spring 2009 semester but had to drop out for medical reasons. She is taking a few courses at the local community college, but they will not count towards her major if she goes back in Spring 2010.

Are these grounds for emancipation?

Your daughter can petition to be emancipated.

She must show that she is able to provide for herself. Living on her own is a good step in that direction.

Is she able to go back to school without your assistance?

I would think that those factual statements in your question constitute grounds for emancipation.
